Acceptance of Terms

By downloading, installing, or using SnapMyRecord ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

SnapMyRecord is a mobile application that allows users to:

• Photograph vinyl records using their device's camera
• Identify records using AI-powered image recognition
• Search the Discogs database for record information
• Manage their Discogs vinyl collection

Account and Authentication

Discogs Account

• To access full features (collection management), you must connect a valid Discogs account.
• You are responsible for maintaining the confidentiality of your Discogs account credentials.
• You are responsible for all activities that occur through your connected Discogs account.
• SnapMyRecord is not affiliated with Discogs and uses their API under their terms of service.

Account Termination

• You may disconnect your Discogs account at any time by logging out of the App.
• We reserve the right to terminate or suspend access to the App for violations of these Terms.

Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App or servers connected to the App
• Use automated systems to access the App in a manner that sends more requests than a human could reasonably produce
• Misuse the AI identification service for purposes other than vinyl record identification
• Violate Discogs' Terms of Service while using their integration

Intellectual Property

Our Content

• The App, including its design, features, and code, is owned by SnapMyRecord and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Your Content

• You retain ownership of any photos you take using the App.
• By using the App, you grant us a limited license to process your photos for the purpose of record identification.

Third-Party Content

• Record information, images, and data retrieved from Discogs are subject to Discogs' terms and conditions.
• AI analysis is provided by OpenAI and subject to their usage policies.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

AI Accuracy

• The AI-powered record identification feature provides best-effort results.
• We do not guarantee 100% accuracy in record identification.
• You should verify important information through official sources.

Third-Party Services

• We are not responsible for the availability, accuracy, or reliability of third-party services (OpenAI, Discogs).
• Service interruptions from third-party providers may affect App functionality.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SnapMyRecord shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the App (if any).
• We are not liable for any loss of data, unauthorized access, or service interruptions.

Indemnification

You agree to indemnify and hold harmless SnapMyRecord from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and SnapMyRecord regarding the use of the App.
